The Cabin service (https://withcabin.com), also referred to on this page as the "Service", is designed, built and operated by Normally Ltd (who are also referred to on this page as "us", "we", or "our").

These Terms of Service ("Terms") explain your rights as the user of Cabin and our rights and responsibilities as the provider of the Service. If you're just browsing the public sections of this website then these Terms are merely a disclaiming and a clarification of the copyright and ownership of the content. If you're signing up to become a user of Cabin then you must agree to abide by these Terms and, in doing so, this becomes a legally binding agreements between you and Normally.

We ask that you read these Terms carefully before using the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. If you disagree with any part of the Terms then you should immediately cease using the Service and contact Normally with your concerns.

Disclaimer

Your use of Cabin is at your sole risk. All materials and information on the Service are provided on an 'as is' basis. We make no warranties, expressed or implied, and we do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or relating activities.

Limitations

In no event shall Normally nor its directors, shareholders, employees, partners, agents, suppliers, or affiliates, be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising from the use or inability to use the Service.

Warranty

Normally and its affiliates and licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Normally Ltd and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Normally Ltd.

Private Beta

Only invited users ("Beta Users") are being given permission to access the non-public components of the Service. During this time ("Private Beta") all parts of the Service will remain free to use by Beta Users. Once we are happy that the Service is stable and fit for use by a wider audience then anyone will have the opportunity to sign up to use the Service.

Fees

Normally charges for access to certain parts and features of the Service. There will continue to be a version of the Service that is free to use in perpetuity (within certain constraints that are to be confirmed) and the fees and how these are applied will be clearly communicated.

Note: Access to the Service will remain free for all Beta Users until further notice.

Deletion of Data

There are different circumstances in which your data may be deleted:

  • Self-initiated There is a feature within the Service that allows the user to delete their domain's data or entire account. WARNING: Data is deleted immediately and cannot be recovered.

  • Auto-deleted It is Normally's intention to limit data retention for non-paying users to a maximum of 30 days (this does not apply during Private Beta).

  • Accidental While Normally go to great lengths to ensure all data storage is resilient and consistent, it is still possible that data may be lost during the development process.

Any data loss or deletion may be irreversible and Normally and its affiliates shall have no liability for any impact that this has on the user or their business.

Fair usage limits

If in Normally's reasonable opinion, you are abusing the Service in any way we may ask you to moderate your behaviour - and in extreme cases, we may limit the data services or we may disconnect you from the Service. This "Fair Usage Policy" is in place to ensure that all of our customers receive a fast and reliable service at a cost that is fair.

If your account receives a considerable amount of hits that causes a sufficient cost to us, above our Free and Pro coverage costs, we may ask you to upgrade or let us provide a custom solution to serve your visitors better. Our payment tiers are designed to provide sufficient service for a very large amount of visitors, but our service limits are kept at our descretion on a customer basis.

Links To Other Web Sites

Our Service may contain links to third-party websites or services that are not owned or controlled by Normally. We have no control or responsibility for the content, privacy policies, or practices of any third-party websites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Governing Law

These Terms are governed by and construed in accordance with the laws of England.
